If you are a US citizen in a long-term relationship with a Thai national, there are several immigration pathways available to help your fiancée or wife reside with you permanently in the US. 

Your partner’s US visa options from Thailand will depend mostly on your relationship status, such as whether you are engaged or already married. For your partner to live in the US permanently, the visas will fall under the immigrant visa category, which allows the applicant to stay in the US in the US, apply for a green card (permanent residence), and receive many of the same rights as US citizens.

Here are the best ways to bring your Thai fiancée or spouse to the US to start a new life.

US K1 Visa

If you are engaged and intend to legally marry in the US, the US K1 Visa may be the most appropriate option. This visa allows your Thai fiancée to enter the US and stay for up to 90 days, during which you must legally marry.

After marriage, your Thai spouse can then file for Adjustment of Status to become a conditional permanent resident and remain in the US for two years. Within 90 days before the conditional resident status expires, you and your wife must file a joint petition to remove the conditional status. If successful, your spouse will receive a renewable 10-year green card.

US K2 Visa

If your Thai fiancée has unmarried children under the age of 21, they may qualify for the US K2 Visa. This visa allows them to travel to the US with her and eventually apply for permanent residency after the marriage and Adjustment of Status. You can apply for K2 visas jointly with the mother’s K1 visa with the same petition, and if successful, the children can travel together with their mother at the same time.

US K3 Visa

If you are already legally married and wish to bring your Thai wife to the US while waiting for their petition for permanent residency to process, the US K3 Visa may be a more suitable option. 

Once she enters the US under this visa category, she can apply for an Adjustment of Status to become a conditional permanent resident and remain in the US for two years. Similar to the US K1 Visa, within 90 days before the conditional status expires, you and your wife must file a joint petition to remove the conditional status so that your wife can receive a renewable 10-year green card. 

US K4 Visa

If your Thai wife has unmarried children under the age of 21, they may qualify for the US K4 Visa, which functions similarly to the K2 visa. This visa allows them to travel to the US with her and eventually apply for permanent residency after the Adjustment of Status. 

US CR1 Visa

If you are legally married and your marriage is less than two years old at the time of the visa application, your Thai wife may be eligible to apply for the US CR1 Visa. This visa will grant your wife two-year conditional permanent resident status the moment she enters the US.

You and your wife must then file a joint petition to remove the conditional status within 90 days before its expiration so that your wife can receive a renewable 10-year green card.

US IR1 Visa

In contrast to the US CR1 Visa, if you are legally married and your marriage is two years old or more at the time of the visa application, your Thai wife may be eligible to apply for the US IR1 Visa. This visa grants your wife a renewable 10-year green card upon arrival in the US, removing the need to apply for an Adjustment of Status and remain in the country for two years as a conditional permanent resident.

Once your Thai spouse holds a green card or becomes a US citizen, they can petition for IR visas for their immediate relatives, such as parents and children.
