Overstaying in Thailand

Should you surrender or be arrested by authorities, your name will be on the blacklist and you will be deported and excluded from Thailand. The length of the blacklist depends on the period of overstay.

Length of Blacklist After Surrendering

  1. Overstaying for more than 90 days will subject you to be excluded for 1 year from your departure date.
  2. Overstaying for more than 1 year will subject you to be excluded for 3 years from your departure date.
  3. Overstaying for more than 3 years will subject you to be excluded for 5 years from your departure date.
  4. Overstaying for more than 5 years will subject you to be excluded for 10 years from your departure date.

Length of Blacklist After Being Arrested

  1. Overstaying for less than 1 year will subject you to be excluded for 5 years from your departure date
  2. Overstaying for more than 1 year will subject you to be excluded for 10 years from your departure date. 

Fines for Overstaying

The minimum fine is 500 THB per day for those who overstay less than 40 days. For example, you overstayed for 5 days, which was summed up at 2,500 THB (500 THB x 5 days = 2,500 THB).

However, the fine can go up to 20,000 THB if you overstay for 40 days or longer.

Exception to the Exclusion

  1. A person who overstays less than 40 days and pays a fine at the airport before departure.
  2. A person aged younger than 18 years old.
  3. A person who does not overstay in Thailand.
