Acquiring Thai Citizenship

Non-Eligible Persons Receiving Thai Citizenship

Section 7 bis of the Nationality Act B.E. 2508 (1965) does not grant Thai nationality to a person born in Thailand to foreign parents during their time of birth due to the following justifications:

  1. The person has been granted leniency for temporary residence in Thailand on a case-by-case basis.
  2. The person was granted permission for temporary stay in Thailand.
  3. The person has entered and resided in Thailand illegally.

However, the Minister may grant Thai nationality to newly-born foreign children in Thailand under the conditions of the Ministerial Regulations. However, they must be based on the following principles:

  1. National security.
  2. Human rights.

Nonetheless, the foreign child born in Thailand are allowed to enter and reside in Thailand without permission. 

Diplomats and International Organizations

Section 8 of the Act does not grant Thai nationality to a person born in Thailand to foreign parents who work as:

  1. A head or a member of a diplomatic mission.
  2. A head or a member of a consular mission.
  3. An officer or expert of international organization.
  4. A family member as a relative under the patronage or a servant of persons under (1), (2) or (3).
