  • US K-1 Visa - allows you as an American to take your Thai fiance/fiancée or girlfriend to the United States with the intention to get married when in the United States.
  • Adjustment of Status - K1 Visa holders who entered the US on a K1 Visa and who married the I-129F petitioner within 90 days of entry to the US is entitle to apply for Adjustment of Status or commonly called as the "green card."
  • US CR-1 Visa - if a US citizen has been married for less than two years with his/her foreign spouse, he/she gets residence on a conditional basis through CR-1 visa.
  • US IR-1 Visa - is another way to sponsor the immigration of a foreign spouse and other immediate relatives of the qualified sponsor can be petitioned to immigrate to the US.
  • US K2 and K4 Visas - K-2 non-immigrant visa allows the children of a K-1 fiancé visa holder to enter into the U.S. while K4 visa allows the children of K-3 spouse visa holder to enter into the U.S. and await the availability of an immigrant visa.
  • US Tourist Visa - allows a Thai citizen to enter the United States temporarily for a holiday, business, vacation, tourism, sightseeing, visits with friends or family, relaxation, hospital treatment, and activities of a social or service nature.
  • EB-5 Visa - allows immigrants and their immediate family to permanently settle in the country if they meet certain requirements regarding the financial investment. The EB-5 program essentially offers wealthy investors, their spouses, and children under the age of 21 a way to obtain a green card and live legally within the US.

  1. Is the K-1 visa for married couples?
No, the K-1 Visa is for a US citizen and Thai fiancée who are free to marry. Married couples are recommended to apply for a US Spouse Visa.
  1. Do we need to meet face to face before we can apply for a K-1 Fiancée Visa?
Yes. You and your Thai fiancée must have met in person within the last 2 years. It is highly recommended that you have kept photos together and other evidence of the relationship such as records of ongoing communication when applying for the K-1 visa.
  1. How long is the process of applying for a K-1 Fiancée Visa?
The processing time is between 12-18 months due to pandemic. This involves the processing of your petition at the USCIS, National Visa Center and the application and interview at the US Embassy in Thailand.
  1. Who is entitled to apply for Adjustment of Status from K1?
K1 Visa holders who entered the US on a K1 Visa and who married the I-129F petitioner within 90 days of entry to the US.
  1. When should I apply for Adjustment of Status?
We advise our clients to apply as soon as practicable after entry into the US, but following marriage. Holders of K1 Visas cannot apply for AOS before they are married and have an original certified copy of their marriage certificate in hand. Bear in mind, and depending on the county in which you were married, it may take some time to obtain the marriage certificate following the actual marriage ceremony. This should be factored in to the timing of any AOS application.
  1. Can I still apply for AOS if the 90 day stay I was given upon entry to the US has expired?
Assuming you married during that 90 day period, you can still apply for AOS. However, you will be "out of status" during any period between the expiration of the 90 days and the receipt by USCIS of your AOS application and technically subject to deportation from the US. Our advice to our K1 AOS clients is always to ensure their AOS application is received by USCIS before the 90 day stay expires. Once the application has been received by USCIS, AOS applicants are granted a period of authorised stay in the US until a decision has been made on their AOS application.
  1. Can I apply for Adjustment of Status outside the US?
No, USCIS requires the applicant to be physically present in the US at the time of application and, following entry to the US and once the application is filed, you will be unable to work or leave the US until your application is approved or you receive Employment Authorisation/Advance Parole, whichever is soonest. If you leave the US before you receive Advance Parole or your AOS application is approved, USCIS will consider your AOS application abandoned. AOS is generally a lengthy process and we advise our clients with an ongoing need to work and/or travel to consider marrying and applying for a CR-1 Visa before they permanently settle in the US.
  1. Should We Apply for a K-3 Visa or CR-1 Visa?
If you wish to apply for a Spouse Visa, it is highly recommended to apply for a CR-1 Visa instead of a K-3 Visa. The K-3 has mostly been phased out and replaced by the CR-1 Visa. On a CR-1 visa, the Thai spouse immediately gets legal permanent residency upon entry to the US.
  1. Who can qualify for an IR visa petition?

A US citizen or a legal permanent resident can file a petition for IR visa to an immediate relative who can be one of the following:

  • Legally wedded more than two years
  • Children below 21 years old
  • Parents
  1. How to apply for EB-5 Visa?
At the consideration stage, it would be very prudent for the applicant to employ the services of an experienced immigration attorney. Considering both the sums of money and the amount of documentation involved in an application for an EB-5 visa, it would be unwise to try and do everything yourself. Please contact us to get the outlined steps involved in obtaining the EB-5.
  1. How can I get a US Tourist visa from Thailand?
The application starts by filling out the DS-160 form online through the embassy website. You need to pay the appropriate visa fee and book a visa interview appointment. You need to attend your visa interview at the US embassy in Bangkok or consulate in Chiang Mai. At the end of the visa interview, you will be informed by the consular officer if your visa was refused or approved.
  1. How long does it take to get a US tourist visa from Thailand?
The application for the US normally can be completed within 2 to 3 weeks depending on the availability of the visa interview appointments. It is recommended to apply for the visa at least 1 month prior to your intended travel to the US.
  1. How much money do I need to show for a US tourist visa?
There is no specific amount of money you must have in order to apply for the visa or in order for the visa to be approved. As long as you have adequate funds to support yourself on the full duration of your trip and you have adequate funds to return to Thailand.
