Marriage in Thailand or Australia: Streamlining Your Path to an Australian Visa

Marriage in Thailand

The place where you register your marriage with your Thai partner is an important factor in the process of applying for an Australian Partner Visa. Each country has its own requirements, including the documents you will need, the processing times, and the associated costs. The location you choose—whether in Thailand or Australia—can significantly impact the complexity of the entire visa application process. By understanding how marriage registration affects your visa application, you can make a more informed decision, avoid unexpected challenges, and ensure a smoother transition for your partner when they move to Australia.

Marriage Registration in Thailand

Some couples prefer to marry in Thailand due to the faster registration process and the ability to start the Australian Partner Visa application sooner, as well as for reasons related to Thai culture and traditions. To register a marriage in Thailand, the following steps must be completed:

  1. Document Preparation: Australian nationals must obtain an Affidavit of Freedom to Marry from the Australian Embassy in Thailand, while Thai citizens need to provide their national ID cards and house registration documents. All paperwork must be in order, and any documents in foreign languages will need to be translated and certified.
  2. Marriage Registration at the District Office (Amphur): Both partners must attend a local district office (Amphur) in person. Once the documents are reviewed, the office will issue a Thai marriage certificate.

How it Affects the Australian Spouse or Partner Visa Application

Marrying in Thailand is often faster and more affordable. The Australian partner can enter Thailand on a Tourist Visa or through the Visa Exemption Scheme to register the marriage. Once the marriage is legally registered, the couple can start the application for the Australian Temporary Partner Visa (Subclass 309), which visa allows the Thai spouse to enter and stay in Australia while awaiting the decision on the Permanent Partner Visa (Subclass 100).

This approach can save time and streamline the visa process for couples planning to live together in Australia.

Marriage Registration in Australia

Registering a marriage in Australia requires more preparation, as it includes a mandatory notice period and several steps after the ceremony:

  • Complete the Notice of Intended Marriage Form: Couples must submit a Notice of Intended Marriage (NOIM) to an approved celebrant at least one month, but no more than 18 months, before the marriage ceremony. The celebrant will assist with the process of submitting this notice.
  • Marriage Registration: After the marriage ceremony, the celebrant is responsible for submitting the signed marriage documents to the Registry of Births, Deaths, and Marriages in the relevant state or territory. This must occur within 14 days of the ceremony. Once registered, couples can request an official marriage certificate from the registry.

How it Affects the Australian Spouse or Partner Visa Application

Marrying in Australia requires the Thai partner to first obtain either an Australian Visitor Visa or a Prospective Marriage Visa to enter the country, which adds both time and cost to the process. Additionally, the mandatory one-month waiting period for the NOIM will delay when the wedding can take place. After registering the marriage, the Thai spouse can then apply for the Australian Temporary Partner Visa (Subclass 820) to remain in Australia while waiting for the decision on the Permanent Partner Visa (Subclass 801).

Pros and Cons: Marriage Registration in Thailand vs. Australia

The following table outlines the main differences between marrying in Australia and Thailand, including factors like travel requirements, fees, and processing times.

When to Choose to Marry in Thailand or Australia

Choosing where to marry is a personal decision that involves balancing cultural traditions, your long-term vision, and your immigration priorities. Whether you want to be surrounded by family in your home country or prefer a quicker route to reunite in Australia, each option comes with its own set of considerations.

Here are some reasons you might consider marrying in Thailand:

  • If you would like a wedding that incorporates Thai cultural or religious traditions.
  • If you prefer fewer immigration steps when registering your marriage and arranging your partner’s entry into Australia.
  • If you are comfortable with a longer wait before reuniting, or if you are willing to stay together in Thailand while waiting for your partner’s visa to be approved.

On the other hand, marrying in Australia may be a better option:

  • If you want family in Australia to be present for the ceremony.
  • If you are eager to start your life together in Australia as soon as possible.
  • If you are willing to accept the one-month waiting period and the requirement for your partner to secure a visa before registering the marriage.
