How do I complete my background check if I have an overstay on my immigration record?

If a Thailand Privilege applicant has an overstay on their record, this will be raised during their background check. These are assessed by the Thai Immigration authorities during this particular stage of their application.

If there is one on file, authorities will notice and review it as part of your clearance. There are usually no additional forms to submit or interviews to partake in. However, in a few cases, some documents are needed.

What do you need to submit?

Immigration Officers may request for a copy of the passport page with the following details:

  • Period of time the applicant overstayed
  • Amount the applicant was fined
  • Confirmation of payment and date the fine was paid

Can you be rejected?

Having an overstay does not automatically disqualify an applicant during their background check, provided the following conditions have been met:

  • The applicant overstayed no more than once in their lifetime.
  • The applicant does not have a history of multiple overstays on their record.
  • The overstay period was already paid for and there is no ban in place for the applicant. 

The rule of thumb is that if you only had one short overstay in the past, then it is not likely that you will be disqualified during the background check.
