The main question we often recieve is:

Why can't I just get a tourist visa to bring my fiancee to the United States?

The answer we give in all situations is that the tourist visa is very difficult to obtain and it has a 90% rejection rate and basically it is discretionary in nature which puts you at the mercy of the embassy here in Bangkok.

Secondly it is also considered fraud on your part if you take oyur fiancee to the United States on a tourist visa with the intent to marry her. If you do so and try to adjust status it could be viewed as fruad by USCIS. You could face possibel jail time and you fiancee could be deported.

Another question that comes with us here at Siam Legal is about children.

Can my fiancee bring her children with us to the United States?

Yes, they can. She can file for a K2 visa under her K1 visa then she can bring her children with her to the United States. They can then adjust their status along with her when the time comes after you marry.

Will my fiancee be able to work when she arrives in the United States?

The answer is yes and no. Its a two part answer however. First of all, once she gets into the United States and you get married she can then adjust her status to a legal permanent resident. At that point she will have a green card and she will be allowed to work like any other green card holder in the United States. Another option before she gets married and before you adjust her status she can also apply for a work permit which would allow her to work before her adjustment of status. Finally another question that comes up.

Can my fiancee leave the United States once entering?

The answer is that the K1 visa is not a multiple re-entry visa.If she enters the United States on a K-1 Visa and then leaves without obtaining advance parole, immigration services will consider her visa to have become abandoned. She will no longer be allowed back into the United States unless she goes through the entire process again.
